Terms of Service

The terms that apply when you accept a proposal from Sutherland Construction, in plain English.

01Scope and this proposal

Your proposal is an offer from Sutherland Construction and Remodeling (“we” or “us”) to perform the work it describes at the price it states. It stays open until the date shown on the proposal. The scope of work, allowances and exclusions written in the proposal govern what is included, and anything the proposal does not describe is not included.

When you sign, the proposal and these Terms together become the agreement between you and us.

02Pricing, deposit and payments

You agree to pay the total shown on your proposal according to the payment schedule shown on it. A deposit is due when you sign, and later payments are invoiced as each milestone in the schedule is reached.

Invoices are due within seven days of the day they are issued. You may pay by card, bank transfer or check. We do not schedule your work or order materials until your deposit has cleared.

03Changes and change orders

Any change to the scope, materials or price must be written down and approved by both you and us before the changed work begins. A change order states the change, its price and any effect on the schedule. Changes are priced separately from the original total and may move the schedule.

04Concealed and unforeseen conditions

Some conditions cannot be seen until work is under way, such as rot, termite or water damage, unsafe or outdated wiring and plumbing, code deficiencies, or hazardous materials. If we find one, we will tell you in writing and may pause work in the affected area. Correcting it requires a change order and may affect the price and schedule.

05Permits, licensing and inspections

Permits and inspections required for the work are addressed in the proposal scope. Their timing is set by the permitting authority and can affect the schedule. Ask us at any time for our Louisiana contractor license details.

06Homes built before 1978

If your home was built before 1978, the lead-safe work practices required by federal rules apply when painted surfaces are disturbed. Lead-safe practices can add cost and time, and your proposal or a change order will say so.

07Access, site and schedule

You agree to give us safe, reasonable access to the work area and to utilities during working hours. Start and completion dates are estimates. Weather, material lead times, inspections and conditions found during the work can move them.

08Warranty

Any workmanship warranty is the one stated in your proposal. A warranty does not cover damage caused by you or others after the work, misuse, lack of maintenance, or normal wear. Products carry their manufacturer’s own warranties.

09Your right to cancel

Where the law gives you a right to cancel a contract signed at your home or away from our place of business, you may cancel by written notice delivered to us within three business days after you sign. If you cancel under that right, we will refund any deposit within ten business days.

Send your notice using the contact details at the end of these Terms. Nothing here limits any cancellation right the law gives you.

10Notice of lien rights

This notice is informational only. Under the Louisiana Private Works Act, subcontractors and suppliers who are not paid for work or materials on your project may have claim rights against the property. Ask us if you have questions about how payments to subcontractors and suppliers are handled.

11Electronic signature

Typing your name and selecting Accept & Sign is your binding signature, with the same effect as signing on paper. We keep a record of when you signed, the total you accepted, the version of these Terms shown to you, and the IP address and browser you signed from. You may print or save a copy of your proposal and these Terms at any time.

12Governing law and disputes

These Terms and your proposal are governed by the laws of Louisiana. Both sides agree to try to resolve a disagreement in good faith before taking further steps.
